Journal Article Review and Analysis

Introduction

The article, “Racial Disparities in the Criminal Justice System and Perceptions of Legitimacy: A Theoretical Linkage” by Michael Rocque seeks to establish the prevalence of racism in the criminal justice system of the United States. The article is a critical evaluation of the way that the delivery of justice to the people of the United States is done mainly concerning the races that exist in the country. The purpose of the article is to establish that even when the criminal justice system of the United States is said to be in the frontline of wiping out racism in the country, it is on the other edge a promoter of racism. The article, therefore, establishes that for legitimacy to be established in the criminal justice system of the united states, racism must be condemned and justice delivered expeditiously regardless of the races of the concerned individuals. 

Study Methodology

The article makes use of the qualitative methodology based on the nature of the study. Theoretical reviews of the criminal justice system of the United States made within the study are based on literature materials, and the whole study is based on literature reviews that concern past incidences where racism has been witnessed and recorded. It can, therefore, be said that the article is based on some established qualitative approach heavily focusing on literature reviews.

Analysis and Discussions of findings

The article finds that racial disparities in the criminal justice system of the United States have an immense impact on the legitimacy of a case. The author concludes that the race of a person facing charges or seeking justice in a court in the United States is likely to affect the way that justice is delivered to the individual. In due regard, as white in the nation is expected to face a more friendly procedure of accessing justice while a black is likely to suffer a stiff process of justice. Consequently, even when whites are the majority, the majority of people behind bars in the nation are composed of the minority population. According to the article, negative attitudes towards the minority races affect the delivery of justice and rarely do they receive the right treatment.

Assessment of impact

In my view, the article presents an important matter that requires heavy scrutiny. It is an article that calls for justice in the criminal justice system and sheds light on the institutionalized racism that has seen the criminal justice system of the United States fall in the trap of racism, thereby judging innocent people the wrong way. 

Personal Thoughts

The article can make a positive impact since it can coerce a better delivery of justice void of racism. The delivery of justice to all individuals accordingly without considering their race is a positive impact on the view that justice will not be based on races but instead by the use of evidence presented. There will, therefore, be less negative attitudes facing the minority races such as the African-Americans while in court offering them and consequently escaping the wrong judgment that would have otherwise met them.

Recommendations

The article, by use of past literature has made informative claims. However, the use of some case studies could have made the research stronger. 

The research ought to be effectively used in the process of establishing a better framework of judgment where the scrutiny needs to be done on cases facing minority races to see to it that they are not discriminated at all.
