            This agreement has been made on this 15th day of October in the Year two thousand and fourteen between Mr. Sam Johnson of physical address 74123-00400 New York (herein after referred to as ‘the Client’ which expression shall where the context so admits, include his assigns, agents, and personal representatives) of the one part and Home Repairs (Halvey & Melby, 2007).

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:
that the repair will only be focused on the left section of the roof that is adjacent to the master bedroom and upper bathroom (Beale & Tallon, 2002).

That this agreement has been drafted to serve the interests of the willing buyer as well as the willing seller.

That the service provider in this agreement has agreed to conduct the repairs outlined by the buyer of his services for a total cost of $12,000 (hereinafter referred to as the contract price).

That the home owner of the house has agreed to paid the contract price in two installments.

That the first payment will be made prior to the commencement of the job and the rest will be provided at the end of the service (Andrews, 2011).

That the repairs will not exceed more than four business days from the day of commencement.

That the repair activities will take place during daytime only.

That the repair activities might be conducted between 10:00 AM  and 4:30 PM.

That the homeowner has agreed to check on the progress of the work every evening throughout the course of the repair.

That service provider shall commence the work on the 15th day of October at 10:00 AM the Year Two Thousand and Fourteen.

That the service provider shall complete the work by, or before, the 18th day of October 2014.

That the service provider will be an independent contractor and is free to involve handymen in the course of the repair.

That payment shall be effected through the service provider’s bank account number as shall be provided.

That if a court of law or statute declares any part of this agreement invalid, illegal or unenforceable the remaining parts remain in full effect and force.

That the agreement shall terminate if any of the parties is declared bankrupt or insolvent by a court of law.

That the agreement shall terminate upon death or insanity of the client.

That in case of any dispute as to the interpretation and/or application of any part of this agreement recourse shall be had to arbitration (Stone, 2003).

That the parties shall be at liberty to choose an arbitrator.

That the agreement shall be subject to the laws of United States of America.

That if a party breaches any of the provisions of this agreement he shall serve the non breaching party with notice to cure the breach and proceed to cure the breach failure to which the non breaching party can proceed to terminate the agreement.

That none of the parties shall be liable for frustration of the contract resulting from circumstances, over which they have no control (Boundy, 2010).
